Terms and Conditions

These terms and conditions apply to all wines sold by Château Bizard.
They apply in full to all contracts between Château Bizard and its customers in France, regardless of the delivery location.
No deviation from these terms and conditions shall be permitted without the written consent of Château Bizard.
Any condition contrary to these general terms and conditions of sale imposed by the buyer, in its general terms and conditions of purchase or in any other document, shall be unenforceable against the seller, regardless of the amount at which it may have been brought to their attention.

1 – Orders and execution

Any order placed with Château Bizard is firm and final for the customer upon receipt by Château Bizard of a purchase order (or any other document indicating an order).
The unavailability of a product due to stock shortages or its removal from the website shall not result in the cancellation of the entire order and shall not entitle the customer to any compensation from Château Bizard.
The products presented on the website www.chateaubizard.fr are offered for sale in mainland France and Corsica.

2 – Price

Prices are inclusive of all taxes but exclude transport costs. All duties and taxes currently applicable or which may become applicable will be charged in addition.
Wines are sold with shipping costs added. Shipping is free for orders over €300.
Wines are supplied at prices based on the price list in effect at the time the order is received.
Prices are subject to change without notice. If delivery does not take place within one month, the prices charged will be those in effect on the day of delivery.

3 – Terms of payment

The prices quoted on the website are inclusive of VAT.
Payment is by credit/debit card only, and you will be redirected to our financial partner’s secure website. The bank authorisation request is encrypted, using the same principle as a standard transaction with a credit card terminal.
Château Bizard will issue a confirmation of payment for the order and send it by email once the order amount has been paid.

4 – Cancellation period

The consumer has a cancellation period of 7 days from receipt of the wine ordered.
If the consumer exercises their right of cancellation, Château Bizard undertakes to refund the sums paid, free of charge, within 15 days of receipt of the returned goods accompanied by a written request for a refund.

5 – Terms of delivery

The delivery times indicated by Château Bizard are given for information purposes only. No compensation may be granted to the customer in the event of failure to meet these deadlines, and no order may be cancelled without the express agreement of Château Bizard. Any order with international delivery can only be processed upon quotation.

5-1 – Shipping costs

Shipping costs are defined according to the rate schedule provided by Château Bizard on the website and are payable at the same time as the invoice. Free shipping is granted for any order over €300 including tax.

5-2 – Receipt of wines

Any claim will only be valid if made within 48 hours following delivery of the wines to the customer, and must be sent by registered mail with acknowledgment of receipt to both Château Bizard and the carrier. In the absence of these elements, no claim will be accepted.
The customer must note any standard reservations on the delivery slip. It is the customer’s responsibility to provide any proof regarding the actual anomalies observed.

6 – Returning wines

Defective wines must be returned to us in their original packaging. The wine in question must be returned by the buyer to Château Bizard in its original condition, at the buyer’s expense and risk.

7 – Retention of Title

Château Bizard retains ownership of the wines sold until full payment of the principal and any additional charges. The delivery of a document creating an obligation to pay (such as a bill of exchange or other) does not constitute payment under this clause. Failure to pay any due amount may result in the reclamation of the wines.
The above provisions do not prevent the transfer to the buyer, upon delivery, of the risk of loss or damage to the goods, including any damage they may cause.
Jurisdiction is expressly assigned to the Commercial Court of Romans for any dispute between the parties, under French law.

8 – Information

The customer declares having read and unconditionally accepted Château Bizard’s terms and conditions as reproduced above.
By express agreement between Château Bizard and the customer, these terms and conditions are governed by and subject to French law.

9 – Protection of Minors

In accordance with Article L.3342-1 of the French Public Health Code applicable to websites selling alcoholic beverages, which states that the sale of alcohol to minors under the age of eighteen (18) is prohibited, the customer agrees to certify that they are of legal drinking age by ticking the appropriate box when placing their order.
